Sewage back-ups… Are you covered?

Sewage backups are a homeowner’s worst nightmare. Not only are they unsanitary, but they can also cause significant property damage, resulting in costly repairs. Many homeowners may assume that their insurance policy covers sewage backup, but unfortunately, that’s not always the case. In this blog, we’ll explore why insurance companies owe for sewage backups.

Firstly, it’s essential to understand that sewage backups can occur for various reasons, including blockages in the sewer line, heavy rainfall, and even tree root intrusion. Regardless of the cause, the damage caused by sewage backups can be extensive, requiring professional cleaning and repairs. This is where insurance coverage comes into play.

Typically, homeowners’ insurance policies cover sudden and accidental damages to the property, and sewage backups fall under this category. The policy will usually include coverage for damage to the structure, as well as personal belongings that are damaged or destroyed as a result of the backup. However, it’s crucial to review your policy and ensure that it covers sewage backup, as not all policies include this coverage.

It’s worth noting that some insurance companies may try to deny coverage for sewage backups, citing exclusions or limitations in the policy. However, it’s essential to remember that exclusions and limitations must be explicitly outlined in the policy for them to be enforceable. If the policy doesn’t contain an exclusion or limitation for sewage backups, the insurance company is obligated to cover the damage.

Another reason why insurance companies owe for sewage backups is that they have a duty to act in good faith when processing claims. This means that insurance companies must investigate claims promptly and fairly, and they must also pay out claims that are covered by the policy. If an insurance company unfairly denies coverage for a sewage backup claim, they are acting in bad faith and may be liable for damages resulting from their conduct.

Insurance companies also owe for sewage backups because they have a legal obligation to act in accordance with state laws and regulations. Many states require insurance companies to provide coverage for sewage backups, and failure to do so can result in legal consequences.

In conclusion, homeowners’ insurance policies typically cover sewage backups, and insurance companies owe their clients for the damage caused by these backups. If you experience a sewage backup, it’s essential to review your policy and ensure that it includes coverage for this type of damage.  Sewage backups are a significant problem for homeowners, but with proper insurance coverage and a knowledgeable insurance company, the damage can be mitigated.   If your insurance company denies your claim unfairly, you may have adjustment or legal options available to you.  Give PCA a call, we would be happy to review your insurance policy and discuss coverage with you.
